2. The petitioner apprehends his arrest for the offences alleged under Sections 401, 353, 307, 186, 201 and 34 of the Indian Penal Code including Section 27 of the Arms Act, registered in connection with Barauni Rail P.S.Case No. 168 of 2023.

3. As per the allegation, some accused persons, including the present petitioner, were planning to commit robbery in trains.

4. The learned counsel for the petitioner has submitted that, for the same occurrence, two cases have been lodged. Barring the present case, another case is Phulwaria

Patna High Court CR. MISC. No.69857 of 2023(2) dt.01-11-2023 2/2 P.S.Case No. 88 of 2023. Nothing was recovered from the conscious possession of the petitioner and his name has figured in the confessional statement of co-accused Umesh Choudhary @ Budha. The petitioner is on bail in all the cases, except Phulwaria P.S.Case No. 88 of 2023, as mentioned in paragraph no.3 of the bail petition.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni,Begusaraai in connection with Barauni Rail P.S.Case No. 168 of 2023, subject to the conditions as laid down under Section 438(2) Cr. P.C.
