2. The petitioner is in custody in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the allegation in the FIR, total 74.4 litres of Nepali made liquor has been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from conscious possession of the petitioner and he has no concern with the alleged recovered liquor. He further submits that there is no

Patna High Court CR. MISC. No.67149 of 2025(2) dt.24-09-2025 2/2 independent eye witness of the seizure list. He next submits that petitioner is in judicial custody since 09.08.2025 and has got two criminal antecedents as stated in para-3 of the bail petition.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. Considering the above facts and circumstances of the case, submission of learned counsel for the petitioner, let the above named petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Exclusive Special Excise Court, Supaul in connection with Sessions Trial Excise No.1678 of 2025 arising out of Nirmali P.S Case No.138 of 2025 with a condition that petitioner shall physically present on each and every date fixed by the learned Trial Court.
