The petitioners apprehend their arrest in connection with Raghunathpur P.S. Case no. 102 of 2019, registered under Section 30(A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, a Truck bearing registration No. UP25DT-2465 was stopped, which was being followed by several bike riders. On seeing the Police personnel, bike riders succeeded to flee away, but the driver of the truck was apprehended, who disclosed his name Jakir Hussain. On search, 450 cartons, each containing 48

On query, the persons present there disclosed the name of eight persons, including the petitioners, who succeeded to flee away. Learned counsel for the petitioners submits that it would appear from the F.I.R. that, on query, informant came to know eight persons succeeded to flee away from the place of occurrence, but it is not detailed that who disclosed the name of petitioners. The petitioners have no criminal antecedents. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IIcum-Special Judge (Excise), Siwan in connection with Raghunathpur P.S. Case No. 102 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
