The petitioner seeks pre-arrest bail in connection with Complaint Case No. 650 of 2017 for the offences alleged under Sections 341, 323 and 498A of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner and opposite party no. 2 jointly submits that the matter was referred before the Patna High Court Mediation Center for settlement of the dispute between the parties, who are husband and wife and both have settled their dispute in terms of the agreement as detailed in memorandum of agreement, dated 19.08.2019, which is part of
Patna High Court CR. MISC. No.71482 of 2018(7) dt.02-09-2019 2/2 the Mediator's Report, dated 20.08.2019.
Since, the petitioner and opposite party no. 2 have settled their dispute, hence, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Complaint Case No. 650 of 2017 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Kaimur at Bhabhua, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
