1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(1), 115(2), 118(1), 109, 326(1), 303(2), 352, 351(2), 3(5) of the B.N.S., 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her hut was set on fire by six named accused persons including the petitioner. It is next alleged that accused also assaulted her by lathi and danda and petitioner assaulted her by an axe causing injury on her cheek, further Tara Devi took away ornaments and cash worth Rs.30,000/-, next alleges that the occurrence took place on account of dispute relating to land.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the order impugned, it would manifest that all those who had approached the learned District Court for seeking anticipatory bail was granted the privilege of anticipatory bail except the petitioner and the reason for rejecting the anticipatory bail application of the petitioner was that he was alleged to have assaulted the informant by axe causing injury on her cheek. It is submitted that the entire family members have been implicated and the dispute was between the female members in which the male members were implicated only with a view to coerce the entire family into submission. It is next submitted that the allegation of putting the hut on fire is an exaggerated allegation and the injury suffered by the injured is simple in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-

No.67562 of 2025(2) dt.07-10-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Raghopur P.S. Case No.48/2025, subject to the conditions as laid down under Section 482(2) B.N.S.S.
