JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Jankinagar P.S. Case No. 84 of 2018 dated 27.05.2018 instituted for the offences under Sections 448, 354(B), 120(B), 34 of the Indian Penal Code. The petitioner No. 2 is alleged to have made attempts at outraging the modesty of the prosecutrix and in which act, the petitioner No. 1 was an associate of petitioner No. 2 as he had driven petitioner No. 2 to the house of the prosecutrix.
The learned counsel for the petitioners has submitted that the reason for lodging the case is something else. In fact, an attempt was made by the family members of the prosecutrix to have her marriage solemnized with
Patna High Court Cr.Misc. No.73289 of 2018(3) dt.15-01-2019 2/2 petitioner No. 2 which ultimately failed. Hence, the present case with false allegation. In fact, petitioners are related among themselves and are also related to the prosecutrix. Petitioner No. 2 is the younger brother of the husband of the aunt of the prosecutrix.
Regard being had to the aforesaid facts as also taking into account the clear intention of the prosecutrix not to prosecute the petitioners any further, for which a petition has been filed in the Court below, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jankinagar P.S. Case No. 84 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
