The petitioner seeks bail in connection with a case registered for the offence punishable u/s 341, 323, 342, 324, 307, 504, 506, 34 of the IPC.

Allegation against the petitioner is of inflicting knife blow upon the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No such occurrence, in the manner as alleged has ever taken place. He has been falsely implicated in this case due to ulterior motive. It is further submitted that the injury was found to be simple in nature but later on it is mentioned as dangerous to life. The entire family member has
Patna High Court CR. MISC. No.69544 of 2024(2) dt.18-10-2024 2/2 been made accused in this case. It is submitted that the petitioner is an Engineer and he is languishing in custody since 05.08.2024. The certificates of the petitioner are enclosed at Annexure-P/5 series. Earlier twice, his anticipatory bail application has been rejected by this Court. The petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Pupri P.S. Case No.08 of 2019, subject to the following condition: (1) The petitioner shall remain physically present in the court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
