Mr.Rabindra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-09-2025 Heard learned counsel appearing on behalf of the petitioners and the learned APP for the State.

2. Petitioners seek pre-arrest bail in connection with Teghra P.S.Case No.154 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 308(2), 352, 351 r/w Section 3(5) of BNS.

3. As per the allegation made in the FIR, petitioners no.1 to 3 are own family members and sons of the petitioner no.4 (Md. Palar @ Ishamul @ Md Ishamul Mansuri). It is alleged that they entered into the the shop of the informant and snatched a Mobile Phone from the shop and destroyed the

4. Mr. Krishnakant Singh, learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have not committed any offence, however, the petitioners are ready to compromise.

5. Mr. Sandeep Kumar Gautam, learned counsel appearing on behalf of the informant submitted that the informant has been put at loss by the act of the petitioners, which can be compensated by the petitioners.

6. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

7. Considering the nature of allegation made in the FIR, as well as, considering the fact that the parties due to trivial reasons entered into fight. There is no description that any article has been destroyed or has been stolen from the shop of the informant. The allegation is only ornamental in nature. The parties have realized that they want to peace of mind and they are ready to resolve their dispute outside the court.

8. The petitioners are directed to appear before the learned District Court on 15.10.2025 at 10.30 am.

9. Learned District Court is directed to take necessary action to refer the matter before the learned Mediator of the

Patna High Court CR. MISC. No.65339 of 2025(2) dt.17-09-2025 3/3 District Mediation Center.

10. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of four months, till then, no coercive action shall be taken against the petitioners in connection with Teghra P.S.Case No.154 of 2025.

11. In case of failure on the part of the petitioners to appear on 15.10.2025 at 10.30 am. before the learned District Court or any date fixed by the learned Mediator, the interim protection granted to the petitioners shall automatically lose its force and the District Court may take appropriate action in accordance with law.

12. In case the parties fail to reconcile then in that case, the parties may avail appropriate remedy in accordance with law.

13. Accordingly, the present bail application stands disposed of.
