====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioner and the State.
The petitioner seeks bail in anticipation of his arrest in connection with Mansoorchak P.S. Case No. 52 of 2018 dated 09.07.2018 instituted for the offence under Section 379 of the Indian Penal Code.
The informant was divested of his mobile telephone. The FIR is registered against unknown. One Mantun Paswan was arrested who confessed that the mobile was sold by the petitioner to one Ram Pravesh for Rs. 500/-.
Learned counsel appearing for the petitioner denies every such statement and has stated that he has been made accused because of some dispute with regard to payment of fair for having hired an auto.
Patna High Court Cr.Misc. No.72032 of 2018(3) dt.11-01-2019 2/2 Considering the aforesaid facts viz. the implication of the petitioner being on the basis of confession only and the petitioner having no criminal antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Begusarai in connection with Mansoorchak P.S. Case No. 52 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
