JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 214 of 2018 dated 08.08.2018 instituted for the offences under Sections 370(a), 342, 344, 374, 34 of the Indian Penal Code and Sections 74, 88, 85, 87, 42, 33, 34 of the Juvenile Justice (Care & Protection of Children) Act, 2000.

A eight year old boy Kunal Kumar was recovered from the establishment of the petitioner which is a sweet shop.

The learned counsel for the petitioner has submitted that the boy who is alleged to have been recovered and against whom it is alleged that he was

Considering the aforesaid facts as also taking into account the fact that in the past the petitioner has not been made accused of such offence, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 214 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
