====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 07-11-2023 Heard Mr. Durgesh Nandan, learned counsel appearing on behalf of the petitioners and Mr. Raj Ballabh Singh, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Mufassil P.S. Case No. 336 of 2022 registered for the offence punishable under Sections 147, 341, 323, 307, 337, 338 , 504 and 506 of the Indian Penal Code.

3. Allegation against 17 named accused is that they have assaulted the son of the informant with a common intention to kill him.

4. Learned counsel appearing on behalf of the petitioners submitted that general and omnibus allegation has

Patna High Court CR. MISC. No.71403 of 2023(2) dt.07-11-2023 2/2 been made against the petitioners who are named in the F.I.R due to enmity. They happen to be member of the mob. Similarly situated co-accused namely Ranjeet Yadav @ Ranjeet Kumar has already been released on anticipatory bail by a co-ordinate Bench of this Court vide order dated 22.05.2023 passed in Cr. Misc. No. 13373 of 2023. Petitioners have clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation being general and omnibus against the petitioners, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya in connection with Mufassil P.S. Case No. 336 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
