APP (SJ) No.4240 of 2019(6) dt.15-11-2021 2/3 This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as 'the SC/ST Act') against the refusal of prayer of anticipatory bail vide order dated 22.08.2019, passed by learned 1st Additional District & Sessions Judge, Sasaram, Rohtas in connection with Dehri SC/ST P.S. Case No.40 of 2019, registered under Sections 147, 148, 149, 323, 324, 379, 504 and 506 of the Indian Penal Code and Sections 3(i)(r)(s) of the SC/ST Act.

The prosecution case, in brief, is that on 17.06.2019, when the informant was working, all the appellants came and abused him. When the informant protested, the appellants assaulted him with lathi, rod and spade and abused him by naming his caste.

Learned counsel for the appellants submits that the appellants are innocent and have falsely been implicated in the present case. There is case and counter case between the sides. It is further submitted that no case is made out under the SC/ST Act.

Learned Special P.P. for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the appellants and submitted that from perusal of

Patna High Court CR. APP (SJ) No.4240 of 2019(6) dt.15-11-2021 3/3 paragraph 55 of the case diary, it appears that the appellants abused and assaulted the informant and four others. Having considered the facts aforesaid, I am not inclined to enlarge the appellants on anticipatory bail. The prayer for anticipatory bail of the appellants is rejected. The appeal is dismissed.
