JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 23-01-2019 The appellants seek pre-arrest bail in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No. 246 of 2016, registered for offences punishable under Sections 341, 323, 353, 379, 504, 506 of the Indian Penal Code and Section 3(I)(R)(x) of SC/ST Act.
Allegation against the appellants is of abusing the informant by taking caste name and also threatening him. Submission of learned counsel for the appellants is that they have falsely been implicated in this case due to bad village politics.
Heard learned Special P.P. also, who opposed the prayer for anticipatory bail of the appellants.
Having heard both sides, considering the facts and

APP (SJ) No.4448 of 2018 dt.23-01-2019 2/2 circumstances of the case as stated above, this appeal is disposed of with a direction to the appellants to surrender before the court below within a period of six weeks and pray for regular bail, which shall be considered on the basis of materials available on record, if possible, to be disposed of on the same day.
