The petitioner is languishing in custody in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

The prosecution case as per F.I.R is that nephew of the informant had informed on his mobile that theft has been committed in his house. The informant thereafter returned to his house and found that theft of golden chain, bungles, kangan, tops buttons worth of several lakhs of rupees have been stolen from his house.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.66044 of 2022(2) dt.27-02-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has been implicated in this case only on the basis of suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 19.12.2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Jhanjharpur in connection with Jhanjharpur P.S. Case No. 267 of 2021.
