1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Biraul P.S. Case no. 480 of 2024 registered under sections 126(2), 115(2), 110, 117(2), 74, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that while the six named accused persons including the two petitioners herein were quarrelling over land dispute, the informant and his wife intervened. It is stated that Mukesh Mahto, Hiralal Mahto and Manoj Mahto started to assault the
Patna High Court CR. MISC. No.65251 of 2025(2) dt.17-09-2025 2/3 informant with an iron rod etc on his head. The assault was followed by another round of beating up by Kusheshwar Mahto and the two petitioners herein causing injury on the hand of the informant. The informant was taken to the hospital for treatment from where on being discharged, the instant case has been registered.
4. Learned counsel for the petitioners submits that the petitioners who are ladies have been falsely implicated in the case. While specific allegation of assault is on Mukesh Mahto, Hiralal Mahto and Manoj Mahto, the allegations against these petitioners are general and omnibus in nature. They have no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners in the F.I.R., the petitioners being ladies, the allegations against them being general and omnibus in nature together with the delay of nine days in registration of the FIR and the petitioners not having any criminal antecedent, it is directed that both the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four
Patna High Court CR. MISC. No.65251 of 2025(2) dt.17-09-2025 3/3 weeks, be released on anticipatory bail in connection with Biraul P.S.
