The petitioner is apprehending his arrest in connection with Complaint Case No.432 of 2017 , T.R.No.2790 of 2018 registered for offences punishable under Sections 498(A) of the Indian Penal Code.

Allegation against the petitioner is of demand of dowry and subjecting his wife to cruelty.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to keep her.

Heard learned A.P.P. and the learned counsel for the O.P.no.2, who has no objection and she is ready to reside with the petitioner if she is allowed to live with the dignity and care

Patna High Court CR. MISC. No.75599 of 2018(3) dt.12-04-2019 2/2 and earlier also the compromise has been reached at the behest of the police official but again she was ousted and torture. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of order and file a petition on oath to keep her with dignity and care and further he is ready to take her from the court itself by filing such application, he will be released on provisional bail in connection with Complaint Case No.432 of 2017, T.R.No.

2790 of 2018 for a period of one year and during that petitioner, both the parties shall appear before the learned court below on the first week of each month and the larned court below will watch the conduct and their marital relationship and only being satisfied with the conduct of both the parites, especially the petitioner, the bail bond of the petitioner shall be confirmed, otherwise he is free to pass any other order or orders including the cancellation of the bail bond of the petitioner. With the aforesaid observation, this application is disposed of.
