The petitioner seeks bail in Araria (Madanpur) P.S. Case No. 257 of 2019 registered for the offence under Section 302 of the Indian Penal Code.

As per F.I.R., the minor daughter of the informant had gone to bring soil from the pond and when she returned, the petitioner inflicted her Dabia blow, as a result of which, the daughter of informant died.

It is submitted on behalf of petitioner that there is contradiction in the written application of the informant and her re-statement and non-examination of elder sister of the informant by the I.O. shows falsehood of this case. It is further submitted that there is no eye-witness to the occurrence.
