Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Gaya Mahila P.S. Case No. 43 of 2022 lodged under Sections 376 and 493 of the I.P.C.

As per the prosecution case, the informant who is aged about 20 years came into contact with the accused in 2021, aged about 22 years. After that, they started talking and meeting with each other. It has been admitted by the informant that they started living together in a ranted house in Mohalla Mastipur, Bodh Gaya. It has been alleged by the informant that gradually the informant developed physical relationship with the

Patna High Court CR. MISC. No.67012 of 2022(2) dt.27-02-2023 2/3 petitioner, on his assurance of marriage but when the informant put pressure of marriage on the petitioner, he left rented house. The informant tried her level best to call him but the petitioner is alleged to be a man of dubious mind and he was not inclined to keep the informant. Due to this reason, the present F.I.R. was lodged.

Learned counsel for the petitioner submits that as per the content of the F.I.R., both the petitioner and the informant are major in age and with consent, they started talking to each other, meeting with each other and living together, since 08.08.2021 onwards, subsequently, the informant became ready to live with him and also accepted his physical relation with her. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 02.06.2022 having clean antecedent. Counsel for the petitioner submits that petitioner is ready to fulfill all the conditions, whatsoever shall be imposed upon him.

Learned counsel for the State opposes the prayer for bail but he also admits that both informant and petitioner were major in age, from the first day of their meeting. In the present facts and circumstances of this case and

No.67012 of 2022(2) dt.27-02-2023 3/3 the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya in connection with Gaya Mahila P.S. Case No. 43 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
