JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Sri Krishnapuri P. S. Case No. 86 of 2019, disclosing offences under Sections 341, 325, 406 and 420 of IPC.

As per F.I.R. petitioner has taken Rs.1,65,000/- as a loan from the opposite party no.2, but he is not returning the same, rather he has started abusing him and snatched Rs.5000/- from him. He has also made an agreement to return the money and agreement also annexed with the F.I.R.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. The money he has taken for supply of the articles, which he has already supplied,

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that agreement paper itself shows that petitioner has taken loan of Rs.1,65,000/- and now he is not returning the same.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
