2. The petitioner seeks regular bail in connection with Uchkagaon P.S. Case No. 252 of 2024 for the offences registered under Sections 329(3), 126(2), 115(2), 118, 109, 352, 303(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, petitioner along with F.I.R. named accused persons are alleged to have abused and assaulted the informant causing injury and took out Rs. 5000/- from his pocket.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. In fact, petitioner and other co-accused persons were playing cricket and some scuffle took place between the parties
Patna High Court CR. MISC. No.74064 of 2024(3) dt.18-12-2024 2/2 due to which case and counter case has been lodged. Injury on the injured is superficial in nature and does not corroborate with the allegation made by the informant. Petitioner is a young boy of 21 years. He has no criminal antecedent. He is in judicial custody since 31.07.2024. Petitioner undertakes to co-operate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Gopalganj in connection with Uchkagaon P.S. Case No. 252 of 2024.
