2. The petitioner has preferred this application for grant of regular bail in connection with Lakhisarai Mahila P.S. Case No. 06 of 2024 dated 20.01.2024 registered for the offences punishable u/ss 376, 506 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the co-accused, Riki Kumar Mahto is alleged to have committed rape on the informant several times by threatening her and he also recorded obscene video of the informant with the help of the

Patna High Court CR. MISC. No.66577 of 2025(2) dt.27-11-2025 2/3 co-accused Rahul Kumar. It is further alleged that the coaccused, namely, Rahul Kumar Mahto and Riki Kumar Mahto always threatened the informant to make her obscene video viral and thereafter they sexually exploited the informant. The informant also alleged that the petitioner Mithilesh Kumar sent obscene video of the informant on her mobile phone. She has further alleged that the petitioner and the co-accused persons are coercing the informant to commit suicide and they also threatened to kill her.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. It is further submitted that the victim is a major girl aged about 27 years. The Charge-sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.07.2025. Similarly situated co-accused has already been granted bail by this court vide order dated 07.05.2025 passed in Cr. Misc. No. 29314 of 2025.

5. Learned counsel for the Informant as well as learned A.P.P. for the State has vehemently opposed the bail

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Lakhisarai Mahila P.S. Case No. 06 of 2024.

7. The application stands allowed.
