This application is for grant of regular bail in connection with Jehanabad Mahila P.S.Case No.45 of 2018 for the offences under Sections 498(A), 341, 323/34 of the Indian Penal Code and Section 3⁄4 of the D.P.Act.

Allegation against the petitioner is of subjecting his wife of cruelty with respect to demand of Rs.03 lac and also 02 katha of land.

Submission of the learned counsel for the petitioner is that he is ready to keep her with dignity and care and as a matter of fact son and daughter are residing with the petitioner.

O.P.no.2 has appeared and the matter was referred

Patna High Court CR. MISC. No.73841 of 2018(5) dt.18-06-2019 2/3 to the Mediation Centre for mediation, however, it appears from the report of the mediator that in spite of their sincere efforts, the dispute could not been settled, however, it is submitted by the learned counsel for the O.P.no.2 that now she is ready to reside with the petitioner, if she is allowed to live with the dignity and care.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let petitioner surrender before the learned court below on 2.7.2019 and on that day the O.P.no.2 shall also remain present in the court and if the petitioner files any application that he is ready to keep her with dignity and care and also ready to take her from the court itself, he will be released on provisional bail in connection with Jehanabad Mahila P.S.Case No.45 of 2018 for a period of six months to the satisfaction of the court below and during that period both the parties shall appear before the learned court below in the first week of each month so that the court may watch their conduct and once being satisfied with the conduct of both the parties especially the conduct of the petitioner, the bail bond of the petitioner shall be confirmed. It is also made clear that on the date fixed by the court, if the O.P.no.2 does not

Patna High Court CR. MISC. No.73841 of 2018(5) dt.18-06-2019 3/3 appear, the court below shall release the petitioner on bail to his own satisfaction.
