====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-12-2018 Heard the learned counsel for the parties.
This application for anticipatory bail arises out of Chapra Muffasil P.S. Case No.206 of 2018, disclosing offences under Sections 341,342,323,324,307,435,504,506/34 of the Indian Penal Code.
It is easily noticeable from the First Information Report that civil dispute between the parties is the reason behind occurrence. It is alleged against the petitioner that he had assaulted one Kumud Ranjan with khanti out of which he received head injury.
Learned counsel appearing on behalf of the petitioner submits that one co-accused Harendra Sah is also said to have assaulted the said Kumud Ranjan has been granted anticipatory
Patna High Court Cr.Misc. No.69633 of 2018(3) dt.17-12-2018 2/2 bail by the Court below.
Considering the submission that the injuries have been found to be simple and the genesis of the occurrence is the civil dispute, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapara in Chapra Muffassil P.S. Case No.206 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
