====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-02-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 66(d) of I.T. Act.
3. Allegedly, all the FIR named accused persons including the petitioners are said to have withdrawn a huge amount i.e. Rs. 41,085/- from the account of the informant.
4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and they have committed no offence. Petitioners have been falsely implicated in this case due to dirty village politics. The allegation levelled against the
Patna High Court CR. MISC. No.68839 of 2023(3) dt.29-02-2024 2/3 petitioners is totally false and based on concocted facts. It is further submitted that similarly situated co-accused, namely, Saro Devi has been enlarged on bail by this bench vide order dated 03.01.2023 passed in Cr. Misc. No. 59045 of 2022. Coaccused Saro Devi has already paid the said amount i.e. Rs. 41,085/- to the informant. Petitioners have no criminal antecedent as mentioned in para-3 of this application.
5. Petitioners are agreed to deposit a sum of Rs.5,000/- (Rupees Five Thousand) each in account of Patna High Court Legal Services Committee, Patna, bearing Account No.1413010060836, IFSC Code: PUNB0141320, Punjab National Bank, Bar Council Branch, Patna.
6. Learned APP for the State opposes the prayer for bail.
7. Having regard to the facts and circumstances of the case, as co-accused Saro Devi has already paid the said amount i.e. Rs. 41,085/- to the informant, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with
Patna High Court CR. MISC. No.68839 of 2023(3) dt.29-02-2024 3/3 Sirdala P.S. Case No. 176 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
8. The bail bonds of the petitioners shall be accepted by the learned Court below on showing receipt of deposit of the aforesaid amount in the Patna High Court Legal Services Committee, Patna.
