JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-05-2020 Heard Mr. Kaushalesh Choudhary, learned counsel appearing on behalf of the petitioner, learned counsel for the State and learned counsel for the Nalanda Zila Parishad through Video Conferencing.
The petitioner in this writ petition sought relief for payment of gratuity and increment with statutory interest admissible to the petitioner.
The learned counsel for the petitioner submits that cases of many of the employees of Nalanda Zila Parishad have been disposed of and, therefore, Zila Parishad, Nalanda is directed to consider the cases of those employees and they were paid their retiral benefits in pursuance of the order of this
Patna High Court CWJC No.8750 of 2017(4) dt.20-05-2020 2/2 Court(Annexure-5 series).
Having considered the facts, I also dispose of this writ petition with a direction to the petitioner to file detailed representation before the Deputy Development Commissionercum-Chief Executive Officer, Nalanda Zila Parishad, Nalanda at Biharsharif whereupon the Deputy Development Commissionercum-Chief Executive Officer, Nalanda Zila Parishad, Nalanda shall consider the representation of the petitioner and also consider the facts that similarly situated employees have already been paid their retiral benefits and pass reasoned order within two months from the date of receipt of such representation. If the petitioner is entitled to get retiral benefits at par with other employees and the yearly increment, the same shall be paid within two months thereafter.
With the aforesaid observation, this writ petition is disposed of.
