====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-02-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Surajgarha P.S. Case No.171 of 2018 registered under Sections 420, 384 and 386/34 of the Indian Penal Code.

The accusation is of demanding the commission by the petitioner being the Mukhiya and one Awadhesh Kumar being the Panchayat Secretary, of Gram Panchayat Raj, Chandanpura, in respect of the different work, done under the Government Scheme. Learned counsel appearing for the petitioner submits that it would appear from the F.I.R. that Baby Kumari, who is Ward Member of Gram Panchayat Raj, Chandanpura, under conspiracy and due to political rivaly, made complaint, making the aforesaid allegation against the petitioner and the Panchayat Secretary to the

Patna High Court Cr.Misc. No.75543 of 2018(4) dt.04-02-2019 2/2 District Magistrate, Lakhisarai, as her candidate, who had contested the election, had lost the election, due to that reason the present case has been lodged. Further submission is that the co-accused Awadhesh Kumar, Panchayat Secretary of Gram Panchayat Raj, Chandanpura, has already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 29.01.2019 passed in Criminal Misc. No.69883 of 2018.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Surajgarha P.S. Case No.171 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
