Petitioner seeks regular bail in connection with Special Case No. 62 of 2022 arising out of Vigilance P.S. Case No. 47 of 2022 registered for the offence punishable under Section 7(a) of the Prevention of Corruption Act, 1988. As per the prosecution, the informant alleged that this petitioner demanded bribe of Rs. 20,000/- for transferring of fund sanctioned under P.M. Gramin Awas Yojna. No.66398 of 2022(3) dt.24-02-2023 2/3 languishing in jail for last five months and investigation has been completed against him and he has been falsely implicated on the basis of false complaint filed by one namely Shiv Kumar Yadav and the petitioner was appointed on contract basis on his post and he never took the alleged bribe and in actual on 16.08.2022 some scuffle took place between the petitioner and Shiv Kumar Yadav, who was making a pressure upon the petitioner to allot another Indira Awas in his favour but the petitioner denied and thereafter he was threatened by the said Shiv Kumar Yadav and consequently he got the petitioner trapped with false allegation. Further submission is that the petitioner is a young boy and he has completed his L.L.
B course and during investigation not a single independent witness was examined though the petitioner was arrested at a public place. Learned counsel Mr. Anil Singh appearing for the Vigilance department has vehemently opposed the bail prayer and submitted that in such type of matter of corruption one should not be enlarged on bail till the framing of charge.
Patna High Court CR. MISC. No.66398 of 2022(3) dt.24-02-2023 3/3 are official witnesses, in the opinion of this court a lenient approach can be taken in respect of the petitioner's prayer. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Special Case No. 62 of 2022 arising out of Vigilance P.S. Case No. 47 of 2022.
Further the bail bond of the petitioner will be accepted after framing of charge.
