2. The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 399 of 2025 for the offences registered under Section 30(A) of the Bihar Prohibition & Excise Act.

3. On getting secret information that petitioner along with other accused persons are manufacturing liquor in Village Belthai near the pond of Lakshman Sahani, police party reached there and apprehended the petitioner. Other accused persons managed to flee away. On search, total 145 litre country made liquor was recovered from there.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner has no concern with the seized liquor. Nothing

Patna High Court CR. MISC. No.69948 of 2025(2) dt.25-09-2025 2/2 has been recovered from the conscious possession of the petitioner. Petitioner was working in his agricultural field he was not present on the spot, the police arrested him illegally. Petitioner has no criminal antecedent. He is in custody since 24.07.2025. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. -1, Civil Court, East Champaran at Motihari, Bihar in connection with Sugauli P.S. Case No. 399 of 2025.
