JUSTICE SANDEEP KUMAR ORAL ORDER 19-10-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in connection with By-Pass P.S. Case No. 294 of 2020 registered for the offence under Section 120B, 420, 414, 467, 468, 471 of the Indian Penal Code and Sections 30(a), 36, 41(i) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2023 and there is recovery of 4815.180 litres of foreign liquor from his possession. Learned APP has vehemently opposed the prayer of bail.
Considering the period of custody and recovery of liquor from his possession, this application for regular bail is

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City in connection with By-Pass P.S. Case No. 294 of 2020. The petitioner will visit Raghopur (Rustampur O.P.) Police Station every Sunday. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
