====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Digha P.S. Case No. 371 of 2025, registered for the offences punishable under Sections 8(c) and 22 of N.D.P.S. Act.

3. 10.63 gms of brown sugar has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 29.05.2025 and claims that there is only one case mentioned vide Digha P.S. Case No. 837 of 2022 is pending against this petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the nature of the allegations and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge (NDPS), Patna / concerned Court below in connection with Digha P.S. Case No. 371 of 2025 subject to the condition that:- (i). The petitioner is directed to mark his attendance in Digha Police Station on every Sunday of each month. Failure to do so, will result in cancellation of bail bonds of the petitioner.

(ii). Before accepting the bail-bond of the petitioner, the Court below shall verify how many criminal cases are pending against the petitioner. It has been stated that he is accused only in one other case, namely Digha P.S. Case No. 837 of 2022. If it is found that he is involved as an accused in any other case(s), his bail-bond shall not be accepted. (Sandeep Kumar, J) Neha/- U T
