JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-02-2021 The present writ petition was though filed for quashing of the order of suspension dated 13.09.2017, but during the interregnum period, charges have been framed under Prapatra- 'Ka' by the Circle Officer, as contained in letter no. 232 dated 06.02.2021.

At this juncture, without going into the merits of the case, I deem it fit and proper to dispose of the present writ petition with the consent of the learned counsel for the parties and with a direction to the respondents (disciplinary authority) to conclude the departmental proceeding within a period of six

Patna High Court CWJC No.21851 of 2019(7) dt.09-02-2021 2/2 months from today, failing which the order of suspension dated 13.09.2017 shall stand revoked automatically and the petitioner would be entitled to regular pay-scale.

It goes without saying that in case the petitioner approaches the concerned respondent authority by filing a representation for grant of subsistence allowance for the period of suspension, the same shall be considered and disposed of in accordance with law by a reasoned order within a period of two weeks, thereafter.

The writ petition stands disposed of on the aforesaid terms.
