JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2019 The petitioner apprehends his arrest in connection with Shekhopur Sarai P.S.Case No. 32 of 2018 registered under Sections 120B, 406,420,467,468 and 471/34 of the Indian penal Code.
Allegation as per FIR is the police received secret information that some miscreants used to deceive money of online consumers pretending themselves that they are agent of Online Shopping company and on that police raided the place and arrested some persons but rest of them succeeded in fleeing away. Their names were disclosed including that of the petitioner. It further appears that petitioner is accused in one more case.
Submission of learned counsel for the petitioner is that he
Patna High Court CR. MISC. No.77664 of 2018(3) dt.12-04-2019 2/2 has falsely been implicated in this case and there is no recovery from him and he is ready to abide by any condition imposed upon him.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 32 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to appear before the police as and when required during investigation otherwise prosecution is at liberty to move for cancellation of his bail bond.
