2. The petitioner seeks bail in connection with Sasaram P.S. Excise Case F.I.R. No. 278 of 2025 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, there is recovery of 1.160 liters of illicit country made liquor from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 12.08.2025. Nothing has been recovered from the possession of the petitioner.
5. Learned A.P.P. for the State has vehemently

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 1, Rohtas at Sasaram in connection with Sasaram P.S. Excise Case F.I.R. No. 278 of 2025.
8. At this juncture, this Court is of the considered opinion that the Exclusive Special Excise Judge, Court No. I, Rohtas at Sasaram is advised not to reject bail application in cases where minuscule/ small quantity of illicit liquor has been recovered, even if the petitioner has antecedents.
