2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. The case of the prosecution is that altogether 300 liters of country made liquor was recovered from an open field behind cowshed of this petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. Learned counsel has further stated that nothing has been recovered from the possession of this petitioner. Learned counsel has also submitted that the petitioner is a man of clean antecedent and is in judicial custody since 14.08.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sonepur P.S. Case No. 797 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Saran at Chapra.
