The petitioner seeks bail in Sri Krishnapuri P.S. Case No. 129 of 2016 registered under Section 392 of the Indian Penal Code.

Four motorcycle borne criminals are said to have looted the motorcycle of the informant.

It is submitted by learned counsel for the petitioner that there is nothing on the record indicting the complicity of the petitioner in the occurrence barring confessional statement made before the police regarding the recovery of motorcycle from his possession. Regarding the said recovery, Alamganj P.S. Case No. 181 of 2016 was instituted against him and he has been enlarged

Patna High Court Cr.Misc. No.31121 of 2017 (2) dt.07-07-2017 2/2 on bail in that case by learned A.D.J.-I, Patna City. Co-accused, namely, Ranjeet Kumar has been enlarged on bail by a co-ordinate bench of this court vide order dated 15.05.2017 passed in Cr. Misc. No. 15906 of 2017. The petitioner has been languishing in custody since 11.11.2016.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna-cum-Special Judge, C.B.I-I, Patna in connection with Sri Krishnapuri P.S.
