The petitioner seeks bail in anticipation of his arrest in connection with Hathouri P. S. Case No. 37 of 2018 dated 21.04.2018 which was initially instituted for the offences under Sections 147, 149, 307, 323, 341, 504 of the Indian Penal Code but later with the death of Ramu Mandal, Section 302 IPC was added.
Learned counsel for the petitioner has submitted that many persons are said to have assaulted the informant and the deceased including the petitioner and in the post-
Patna High Court Cr.Misc. No.73576 of 2018(3) dt.15-01-2019 2/3 mortem, the death is shown to have been caused by one injury suffered by the deceased on his occipital region of the head. There is a counter version of the occurrence as well in which some of the persons of the side of the petitioner also have been injured. In similar circumstances, three of the accused persons have been granted anticipatory bail by a Bench of this Court vide order dated 18.09.2018 passed in Cr. Misc. No. 58355 of 2018.
The petitioner does not have any criminal antecedents.
Regard being had to the aforesaid facts as also taking into account that similarly situated persons have been granted anticipatory bail, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 2nd Rosera, Samastipur in connection with Hathouri P. S. Case
