Petitioner is apprehending his arrest in connection with Excise Cae No.434 of 2019 arising out of Piro P.S.Case No.67 of 2019 , registered for offences punishable under Sections 38(ii) of the Bihar Prohibition and Excise Act, 2016. As per the FIR rice mill of the co-accused was raided and there is recovery of huge quantity of liquor and the co-accused has disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused nothing has come against petitioner and he has no criminal antecedent and the case diary has also been called for and that also shows no other incriminating materials against this

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Addl. District & Sessions Judge, Ara, Bhojpur in connection with Excise Case No.434 of 2019 arising out of Piro P.S.Case No.67 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
