For the Petitioners :
Mr. Pankaj Kumar, Advocate For the Opposite Party :
APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 05-03-2019 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 325, 354, 384, 385, 504 and 506/34 of the Indian Penal Code registered in connection with Biraul P.S. Case No. 12 of 2018.
3. It is submitted that the petitioners have been falsely implicated in the backdrop of past enmity between the parties who happen to be neighbours. Such cases have been filed by the informant also in the past. The accusation of assault by four accused persons is not corroborated by the injury report which discloses only one injury on the person of the informant.
4. Considering, however, that the injury on the informant Aasharfi Khatoon is grievous in nature, this Court is not inclined to grant anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed.
