JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State .
2. The petitioners apprehend her arrest in a case registered for the offence punishable under Sections 103(1), 61(2) and 3(5) of the B.N.S. and Section 27 of the Arms Act. 3 . As per prosecution cas e, informant suspects that due to old land dispute, all the F.I.R. named accused persons, including these petititioners, killed the husband of informant.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is only alleged to conspirator and they are not alleged to have participated in the murder of husband of the informant. Informant is not an eye witness of the alleged occurrence and only suspicion has been raised against this petitioner on account of previous land dispute between the deceased and co-accused Anand Prakash . Except, suspicion , there is no other material on record to show the complicity of these petitioners in the alleged occurrence . Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case , and clean antecedents of these petitioners, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Vaishali, Hajipur in connection with Bidupur P.S. Case No. 326
