This application for regular bail arises out of Baikunthpur P.S. Case No. 97 of 2019, disclosing offence punishable under Sections 304-B and other allied Sections of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

The petitioner is the husband of the deceased. The Investigating Officer of the case is personally present in Court in compliance of the order dated 06.03.2020. He has referred to the materials collected in course of the investigation to submit that the petitioner, in order to cause disappearance of the evidence of the offence committed by him, burnt the dead body of the deceased in haste.

Patna High Court CR. MISC. No.78212 of 2019(4) dt.17-03-2020 2/2 Learned counsel appearing on behalf of the petitioner, on the other hand, has submitted that the deceased died of heart attack and an information to this effect was given to the family members of the deceased.

Be that as it may, considering the materials collected in course of investigation, particularly the statement of the minor daughter of the deceased recorded under Section 161 of the Cr.P.C., I am not inclined to grant the petitioner privilege of regular bail.

This application is accordingly rejected.

Personal appearance of the Investigating Officer stands dispensed with.
