ANJANA MISHRA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.07.2019 in connection with Barhara P.S. Case No.217 of 2019 registered for the offence under Sections 302, 120B read with Section 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner's name has been taken by the informant only on the basis of suspicion and there is no cogent evidence to show that the petitioner was in any way connected with the murder of the son of the informant. It is further submitted that the petitioner has been falsely implicated in connection with the present case and he has no criminal antecedents. It is further

No.61157 of 2019(2) dt.04-11-2019 2/2 submitted that the name of the petitioner in the commission of the murder of the deceased has transpired only in the extrajudicial confession of the co-accused Akshay Rai and Manager Paswan and there is no eye-witness to the occurrence.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara, in connection with Barhara P.S. Case No.217 of 2019.
