2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. The case of the prosecution is that from a bike altogether 50 liters of country made liquor was recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. Learned counsel has submitted that nothing has been recovered from the possession of this petitioner. The only reason he has been framed in this case as he is the owner of the bike. The petitioner is in judicial custody since 25.07.2025.

5. Learned Additional Public Prosecutor for the State

Patna High Court CR. MISC. No.65290 of 2025(2) dt.23-09-2025 2/2 has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of five cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall not indulge in similar nature of offences in future. The above named petitioner is directed to be released on bail in connection with Excise P.S. Case No. 1029 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-II, Aurangabad.
