JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Manigachhi P.S. Case No. 240 of 2018 registered for the offence under Sections 341, 323, 324, 325, 307, 354, 379, 504 of the Indian Penal Code. Accusation against the petitioner is of giving blow Farsa on the head of the informant, causing cut injury and thereafter, all accused persons assaulted the informant and his family members with iron rod, due to which right hand wrist of the daughter of the informant was fractured. It is submitted by learned counsel for the petitioner that due to land dispute in between the parties,

No.62012 of 2019(3) dt.19-11-2019 2/2 the petitioner and his family members were made accused in the present case and there was case and counter case in between the parties. Accused Ramphal Yadav (father of the petitioner) also filed a complaint before the Gram Cutchery. He further submits that the petitioner has no criminal antecedent.

Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Manigachhi P.S. Case No.240 of 2018, subject to conditions as laid down under Section 438(2) Cr.P.C. (Anjani Kumar Sharan, J) nawalkrs/- U T
