2. This is the second attempt of the petitioner for grant of regular bail in connection with S.Tr. No. 116 of 2024 arising out of Araria (Bairgachhi) P.S. Case No. 786 of 2023 registered for the offence under Sections 392 of the Indian Penal Code.

3. As per the prosecution case, unknown criminal are said to have looted 1,15,105/-. The name of the petitioner has come during investigation.

4. The petitioner is in custody since 25.9.2023 and Rs. 15,000/- has been recovered from the house of the petitioner.

5. It has been submitted by the learned counsel for

Patna High Court CR. MISC. No.69916 of 2024(4) dt.10-12-2024 2/3 the petitioner that the petitioner undertakes to pay a part of the alleged looted amount without accepting his guilt and without being prejudiced to his case and his rights.

6. Considering the aforesaid facts and also considering the undertaking of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Araria in connection with S.Tr. No. 116 of 2024 arising out of Araria (Bairgachhi) P.S. Case No. 786 of 2023.

8. At the time of furnishing bail bonds, the petitioner is directed to bring a demand draft of Rs. 25,000/- in the name of the present Branch Manager of Bharat Finance Limited, Halim Chowk, Araria which shall be handed over to the Branch Manager of Bharat Finance Limited, Halim Chowk, Araria after verifying his credentials. If the petitioner brings the demand draft of Rs. 25,000/- then his bail bonds shall be accepted by the Court below and if fails to do so then the bail bonds of the petitioner shall not be accepted.

9. As a condition of this order, the petitioner after

Patna High Court CR. MISC. No.69916 of 2024(4) dt.10-12-2024 3/3 being released on bail is directed to mark his attendance at Madanpur Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

10. It is also observed that if the petitioner if found engaged in any fresh case, his bail bonds shall be cancelled by the Court below automatically.
