Petitioner apprehends his arrest in Bhagwanpur P.S. Case No.182 of 2018 registered under Section 307 and other sections of the Indian Penal Code.
The informant Vinod Kumar Rai alleged that while he was constructing house on his land, the accused persons started constructing house on the disputed land. When the informant requested them not to construct house till the decisions of the court in Case No.39 of 2018, the accused persons came and assaulted the informant. The petitioner Ramanuj Rai @ Ram Anuj Rai is alldged to have assaulted the informant with sharp edged weapon on his head causing head injury and the informant fell down after becoming unconscious. Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.74173 of 2018(3) dt.09-01-2019 2/2 occurrence took place on account of land dispute. There is a counter version being Bhagwanpur P.S. Case No.183 of 2018. The informant got one lacerated wound on head which is superficial in nature but the opinion was at the first instance reserved for X-ray. After X-ray no bony injury was found and the nature of injury is opined to be simple in nature. Considering the facts that on account of land dispute, the occurrence took place and the assault made by the petitioner caused simple injury on the head, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Bhagwanpur P.S. Case No.182 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
