2. The petitioner apprehends arrest in connection with Basopatti P.S. Case No. 103 of 2025 dated 04-05-2025, instituted under Sections 274, 275 and 3(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise Act 2022.

3. The allegation is of recovery of 54 litres of Nepali saufi luoqur from a motorcycle bearing Chassis No. ME4JC652DF7030969, Engine No. JC65E70098849 which belongs to the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in the present case. It is further submitted that the petitioner is a

Further, it is submitted that the petitioner was not arrested at the spot. It is specifically submitted that the petitioner is the owner of the said motorcycle. It is further submitted that on 21.4.2024, she went to Pupri market along with her husband, where her motorcycle was stolen in Pupri market, District Sitamarhi. A complaint regarding the theft was lodged on 22.4.2024; however, the police have not registered the case. A photocopy of the written petition dated 22.4.2024 has been annexed as Annexure P/2 to the bail petition. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (Excise Court) Madhubani, in Basopatti P.S. Case No. 103 of 2025 corresponding to GR No. 598 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
