The petitioner apprehends his arrest in connection with Patna Cyber P.S. Case No.813 of 2024, registered for the offence punishable under Sections 419, 420, 468, 120B of the Indian Penal Code and 66C and 66D of Information Technology Act, 2000.

As per the FIR, on the basis of a secret information, the informant apprehended four persons, who disclosed that they act together in committing cyber fraud. They also disclosed the name of the petitioner as their associate.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He

Patna High Court CR. MISC. No.74212 of 2024(2) dt.28-10-2024 2/2 has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. There is no specific overt act against the petitioner. He has been made accused on the basis of statement of apprehended co-accused persons. Petitioner has one criminal antecedent in similar nature of offence.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as the petitioner has one criminal antecedent in similar nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

Accordingly, this application is dismissed.
