ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.07.2019 in connection with Agamkuan P.S. Case No.627 of 2019 (Special Case No.5993 of 2019) registered for the offence under Sections 30(a)(b)/37(c)/38/41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner worked in a private shop at Mushalhpur and remained outside his home all day, but the present case was lodged against him and the signature of the petitioner was taken on the seizure list. Learned counsel submits that the alleged recoveries were not from his conscious possession and he has no criminal antecedents.

No.70689 of 2019(3) dt.19-11-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Special Judge, Excise, Patna, in connection with Agamkuan P.S. Case No.627 of 2019 (Special Case No.5993 of 2019).
