The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 326, 307, 353 of the Indian Penal Code.

The prosecution allegation, in short, is that the accused persons assaulted a thief which was caught in a village. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. A thief was caught

Patna High Court CR. MISC. No.61203 of 2019(3) dt.04-12-2019 2/2 and beaten up by the villagers and subsequently in course of treatment, the said thief is said to have succumbed to the injuries but till date Section 302 IPC has not been added. Altogether 6 persons were named in the F.I.R. along with 40-50 unknown persons. For the same occurrence, two different cases were instituted. The petitioners happen to be informant of the other case which was instituted for the same occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sumit Kr. Singh, Judicial Magistrate, 1st Class, Jamui in connection with Chandramndih P.S. Case No. 67/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
