Petitioners apprehend their arrest in Barauni P.S. Case No.75 of 2017 registered under Sections 308, 338, 323, 341 and 34 of the Indian Penal Code.

The informant alleged that the electric wire was lying on the road and for that some verbal altercation took place. The informant further alleged that all the accused persons assaulted him and his son Shashi Mohan Singh with iron rod. The accused persons also assaulted him with bricks and stones. Learned counsel for the petitioners submits that there is counter version being Barauni P.S. Case No.74 of 2017. The

Patna High Court Cr.Misc. No.75330 of 2018(3) dt.10-01-2019 2/2 injuries sustained by the informant and his son are simple in nature caused by hard and blunt object.

Taking into consideration the fact that there is a case and counter case and it appears that both the sides entered into verbal altercation and mutual assault on account of fall of electric wire and the injuries sustained by the informant and his son are simple in nature, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Barauni P.S.
